Is this considered illegal?

I like the character and personality of Alex Russo which is created and owned by Disney, and I want to start a novel, and Alex will be the main character. But the novel will contain different settings and plots, than of Wizards of Waverly Place, she won't be a wizard or anything, is this considered illegal for taking the name?
